Trademark

Payment of the dues and fees can be made by bank transfer, deposit on the account of the Bureau for Intellectual Property on account number 171937-01 at Banco di Caribe N.V., 130211603 at Maduro & Curiel’s Bank N.V., cash or via the pin system at the desk.

The deposit of a trademark:

1. for an individual trademark a basic amount of: NAƒ 750.00;
2. for a collective trademark a basic amount of: NAƒ 1500.00;
3. for each class of goods and services above the third class of the international classification in which the goods and services are categorized, for an individual trademark, a supplement of: NAƒ 75.00;

The renewal of the registration of the deposit:

1. for an individual trademark a basic amount of: NAƒ 750.00;
2. for a collective trademark a basic amount of: NAƒ 1500.00;
3. for each class of goods and services above the third class of the international classification in which the goods and services are categorized, a supplement of: NAƒ 75.00;

An investigation as contemplated in article 16 of the National Trademark Decree;

1. for each investigation a basic amount of: NAƒ 375.00;
2. for each class of goods and services above the third class of the international classification in which the goods and services are categorized, a supplement of: NAƒ 37.50;
3. If a collective trademark is involved, a supplement of: NAƒ 75.00;
4. The additional charge referred to in article 16, fourth and fifth paragraphs: NAƒ 150.00;

The registration of special declaration regarding the right of priority claim referred to in article 10, seventh paragraph of the national ordinance, for each trademark: NAƒ 75.00;

The registration of an assignment or change of ownership: NAƒ 150.00;
if this registration is requested for several trademarks, for each following trademark: NAƒ 75.00;

The registration of a licence, a lien or an attachment or the cancellation of such a registration; NAƒ  150.00;
if the registration or the cancellation is requested for several trademarks of which a licence or lien has been granted to the same person or of which an attachment has been made by the same person, for each following trademark: NAƒ 75.00;

The registration of any change of name or address of the holder, licensee, lienor or attachor; NAƒ   150.00;
if the registration is requested for several trademarks belonging to the same holder, have been granted under licence to the same licensee, have been pledged to the same lienor or that have been attached by the same person, for each following trademark: NAƒ 37.50;

The registration of a limitation of the statement of the goods and services, except on the occasion of the renewal of the registration: NAƒ 75.00;

For the publication of the description referred to in article 2, sixth or seventh paragraph, respectively, a supplement each time amounting to: NAƒ 75.00;

The registration of any change of name or address of the agent, for all the trademarks for which the Bureau considers the agent involved to be an agent: NAƒ 150.00.

For the transactions mentioned below a charge or fee is paid, of which the amount is established as follows:

1. correction of the registration, at the request of the holder of the registration, after the entry has been made, of writing errors due to himself: NAƒ 37.50
2. list of trademarks, referred to in article 16, sixth paragraph, for each investigation criterion: NAƒ 75.00;  for each class of goods and services above the third class of the international classification in which goods  and services are categorized, this amount is increased by: NAƒ 15.00;
3. the additional charge, payable in pursuance of article 11, first paragraph: NAƒ 150.00;
4. the information referred to in article 18: NAƒ 75.00; for each hour that collecting and recording in writing of the data requested exceeds one hour, this amount is increased by: NAƒ 112.50;
5. the transcripts of a registration as contemplated in article 18, for each registration: NAƒ 15.00;
6. for all other transcripts, for each page: NAƒ 22.50;
7. authenticated transcripts of a registration, as contemplated in article 18, for each registration: NAƒ 52.50;
   for all other authenticated transcripts, for each page: NAƒ 60.00;
8. the documents with regard to preference, referred to in article 19: NAƒ 52.50;

Trademarks Journal:

for each single copy: NAƒ 75.00;
for an annual subscription: NAƒ 525.00;
for a single copy outside Curaçao: NAƒ 85.00;
for an annual subscription outside Curaçao: NAƒ 600.00.
International Registration

The filing of an international trademark:

1. for an individual trademark a basic amount of: NAƒ 450.00;
2. for a collective trademark a basic amount of: NAƒ 450.00;

The renewal of an international registration:

1. for an individual trademark a basic amount of: NAƒ 450.00;
2. for a collective trademark a basic amount of: NAƒ 450.00;

The International registration:

1. for an individual trademark a basic amount of: NAƒ 583.50;
2. for a collective trademark a basic amount of: NAƒ 1159.50;
3. for each class of goods and services above the third class of the international classification in which the goods and services are categorized, for an individual trademark, a supplement of: NAƒ 60.00;
4. for each class of goods and services above the third class of the international  classification in which the merchandise and services are categorized, for a collective trademark, a supplement of: NAƒ 118.50;

The renewal of the registration of the deposit:

1. for an individual trademark a basic amount of: NAƒ 583.50;
2. for a collective trademark a basic amount of: NAƒ 1159.50;
3. for each class of goods and services above the third class of the international classification in which the goods and services are categorized, a supplement of: NAƒ 60.00;
4. for each class of goods and services above the third class of the international classification in which the goods and services are categorized, for a collective trademark, a supplement of: NAƒ 118.50;
